Terms and Conditions for the use of SAINTNFTART

These Terms and Conditions govern your use of the NFT marketplace saintnftart.io provided by SAINTNFTART. By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use the Platform.

Definitions unique digital asset stored on a
a. "NFT" refers to a non-fungible token, a blockchain.
b. "User" refers to any individual or entity accessing or using the Platform.
c. "Content" refers to any digital assets, including
NFTs, uploaded or shared on the Platform.


Account Registration
a. Users must create an account to access the Platform.
b. Users must provide accurate and complete information during the registration process.
c. Users are responsible for maintaining the confidentiality of their account credentials.


Use of the Platform
a. Users may use the Platform to browse, buy, sell, and trade NFTS.
b. Users may upload and share their own NFTs on the Platform.
c. Users must comply with all applicable laws and regulations while using the Platform.
d. Users are solely responsible for the accuracy, legality, and ownership of the Content they upload.


Ownership and Licensing
a. Users retain ownership of their NFTs uploaded to the Platform.
b. By uploading Content, Users grant the Provider a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute the Content for the purpose of operating and promoting the Platform.
c. Users acknowledge and agree that the Provider is not responsible for the enforcement of intellectual property rights related to the Content.


Prohibited Activities
Users must not engage in the following activities while using the Platform:
a. Violating any applicable laws or regulations.
b. Uploading or sharing Content that infringes upon the intellectual property rights of others.
c. Uploading or sharing Content that is obscene, defamatory, or illegal.
d. Impersonating any individual or entity.
e. Engaging in fraudulent activities or misrepresentations.
f. Interfering with the proper functioning of the Platform.


Fees and Payments
a. Users may be charged fees for certain transactions on the Platform, as determined by the Provider,
b. Users are responsible for any applicable taxes related to their use of the Platform.
c. The Provider may modify the fees and payment terms with prior notice to the Users.


Disclaimers and Limitation of Liability
a. The Platform is provided on an "as-is" basis, without warranties of any kind, either expressed or implied.
b. The Provider does not guarantee the accuracy, completeness, or availability of the Platform or its Content.
c. The Provider shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Platform.
d. Users agree to indemnify and hold the Provider harmless from any claims or damages related to their use of the Platform.


Termination
a. The Provider may suspend or terminate a User's account at its sole discretion, without prior notice.
b. Users may terminate their account by contacting the Provider.
c. Termination of the account does not release Users from their obligations under this Agreement


Modifications
The Provider reserves the right to modify or update this Agreement at any time. Users will be notified of any material
changes to the Agreement. Continued use of the Platform after such changes constitutes acceptance of the modified Agreement.


Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Provider is registered or operates its business (United States). Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Severability If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The invalid, illegal, or unenforceable provision shall be deemed modified to the extent necessary to make it valid, legal, and enforceable.

Entire Agreement
This Agreement constitutes the entire agreement between the Users and the Provider regarding the use of the Platform and supersedes any prior agreements or understandings, whether written or oral.

Waiver
The failure of the Provider to enforce any provision of this Agreement shall not be considered a waiver of that provision or any other provision. Any waiver of any provision of this Agreement must be in writing and signed by the Provider to be valid.

Assignment
Users may not assign or transfer their rights or obligations under this Agreement without the prior written consent of the Provider. The Provider may freely assign or transfer its rights and obligations under this Agreement to any third party without User's consent.
